POSITION OVERVIEW :
Leads and performs both procurement and contract management duties for public sector infrastructure and public works programs pertaining to design-build (DB), public-private partnership (P3) and other related innovative project delivery programs. This includes the solicitation and selection activities leading to the award of DB and P3 contracts for owner required services involving design-builders and concessionaires, with oversight of these contracts post-award through the application of effective management and contract compliance practices. In the procurement stage, works to provide an open and fair solicitation process leading to a competitive selection process and award of a contract that is in compliance with federal, state and local laws and regulations, as well as the objectives of the owner and the project. In the project delivery stage, prepares and provides for the mitigation and settlement of changes and claims through the appropriate use of project correspondence, documentation practices, change management and dispute resolution processes and the effective collaboration with program staff and owner contracting officials and legal counsel.
This position generally reports to the Program/Project Manager in the performance of procurement and contract management duties for an owner’s program. The reporting relationships and responsibilities may vary depending on the scope, type and value of the program management services provided.
SPECIFIC RESPONSIBILITIES :
Leads the effort to develop appropriate procurement strategies for the type of projects, consistent with the federal, state and local procurement laws and regulations and owner’s objectives and goals in accomplishing the best value to the owner and to the public. Coordinates with the owner’s procurement and legal staff, and other state and federal agencies as required to define the procurement approach and processes leading to a successful award of a contract.
Manages the collaboration and coordination with program technical and management staff in developing the technical provisions and reference materials, providing clear and concise requirements, including risk allocation and mitigation requirements that are established through project development and risk planning activities for selected procurement strategies.
Lead, and/or coordinate with owner procurement personnel and counsel to develop the expression of interest and qualification documents, including the establishment of qualification criteria, necessary to determine the list of qualified firms with the capacity and capability to deliver a project. Administer the evaluation process to achieve the list of prequalified firms.
Lead, administer and/or coordinate with owner procurement personnel and counsel to develop the proposal documents, providing the requirements for the submission of proposals, the selection process, and the award and formation of the contract. Conduct and administer the proposal process with the prequalified firms through to the evaluation and selection of the business entity determined to best meet the award criteria.
Facilitate the final documents, submittals and administer the evaluation and award processes in compliance to procurement regulations necessary to accomplish the award of a contract to the successful business entity and support the agency in preparing for the board actions in gaining all approvals for the award.
Coordinate with federal, state and local agencies throughout the procurement process to obtain necessary approvals. Provide guidance, input and assure compliance to federal, state and local laws and regulations pertaining to the identification of appropriate procurement strategies, solicitation requirements, contract requirements and award of contracts.
Performs reviews of project contract documents and establishes program guidelines, processes and procedures by which contract management and federal, state and local compliance practices will be administered by the program team over the owner’s contracted parties. Serves as the point of contact for the contracts team and coordinates the interface between the contracts management function and other technical, management and control functions of the program team on contractual issues.
Leads the early establishment of program communications and controls the document program activities and correspondence providing risk mitigation and support to the owner in defense of changes and claims.
Maintains a thorough understanding of contract formation practices and has working knowledge of contract terms and conditions for design and construction and design-bid-build contracts (including indemnification, insurance, damages and default language) to ensure compliance with contract obligations. Collaborate with an integrated program team, including owner and internal legal and procurement counsel to resolve contract issues.
Keeps apprised of the federal, state and local agency regulatory and procedural requirements related to contract administration and change management to achieve the necessary documentation, reviews and approvals, and to develop program or project procedures consistent with owner requirements. Regularly communicates and coordinates with owner and other agency staff to efficiently conduct contract management and administration practices and activities.
Provides leadership to the program staff in the administration of the contract. Collaborates with others to resolve complex issues involving contract interpretation, advice and recommendations in seeking timely resolution of issues.
Responsible for managing and maintaining documentation for supporting the resolution of program related issues regarding the performance of work by the parties under contract to the owner, and further into the timely processing of change orders and claims. Directs and participated in the organization and facilitation of change orders and claims, including their review, tracking and processing through resolution and owner approvals.
Conducts meetings and ensures the preparation of documents to report on the status of contract management activities, including meetings associated with the resolution of issues, changes and claims. Coordinates with the owner on contract management activities, as required to seek necessary reviews and approvals of actions and recommendations.
Coordinates with federal, state and local agencies as required throughout the program on contract management compliance and approvals as required by law, regulations or practices. Facilitate the necessary meetings and communications supporting owner compliance to such requirements.
Assures the establishment of correspondence processes, procedures and requirements. Prepares all forms of correspondence related to contract matters, whether in initiation, or in response, to contract interpretation, notifications or compliance. Establishes correspondence processes, procedures and requirements and monitors timely and proper communications and notices under the contract.
4-year degree in Business Administration, Finance, or related field and 12 + years of prime contract management experience on large scale infrastructure programs or projects required. Candidate should have a broad general technical and business background with P3 experience. Law degree is a plus.
